STOP THE FRAUD! Lands Minister, Kamya, Writes To Kira RDC on Land Row

The dispute on the land comprised on Block 185 Plot 385 Kyadondo has been going on for some time.

Even when court decreed that Yusuf Ssemakula and Alice Nabitosi, 85, are the lawful and bonafide bibanja holders, a one Tugume Winnie, by the aide of police and Registrar of Titles, Wakiso Zonal officer, Sarah Nakiwoolo, has been threatening Ssemakula and Nabitosi over an impending eviction.

However, in July this year, Nabitosi’s lawyers wrote to the land ministry, petitioning the ministry over the conduct of Nakiwoolo.

“We are advocates for Nabitosi Alice herein referred to as our “Client” on whose instructions we address you and seek your urgent attention as hereunder;” lawyers of Kikomeko, Kayiira & CO. Advocates wrote to the ministry with a copy to the Director, Criminal Investigations. “Our client is a kibanja holder on part of land comprised in Kyadondo Block 185 Plot 385 at Kito, Kira, Namugongo and the neighboring plots. (Copies of the Court decree and permanent injunction are attached and marked as annextures “a” & “B” respectively.  As you are perfectly aware, drawing from our previous correspondences to your office, the above –mentioned land and bibanja thereon are a subject of conflict following numerous failed attempts by Ms. Winnie Tugume to evict our Client and other bibanja holders,” The lawyers also wrote to the CID director, AIGP Grace Akullo.

“Our clients filed caveats on 5^th of June to Wakiso Lands Registry but up to now they’re not completed on the system only to get bullied by Namukasa Hasifa that they’re going to be vacated in a matter of time,” part of the letter reads, explaining the reason for writing to the ministry. “The purpose of this letter is to request your indulgence as the vanguard of the law to call in the relevant government institutions officials to operate within but not to abuse the law and to respect the rights of our Clients and the institutions from which they obtained legitimate help,” the lawyers wrote.

This news site understands the letter dated July 9, 2020 was received at both the CID headquarters, Kibuli and the ministry on July 15, 2020.

In the letter, Nabitosi wanted the CID to act on Nakiwoolo for deliberately failing to lodge caveats on Block 185 Plot 385.

Earlier, the same lawyers wrote to the registrar blocking any person from transferring titles of the said land or acting on any instrument affecting Nabitosi’s estate or interest without authorization. This letter was received on June 5, 2020 at Zonal offices, Wakiso. The letter was followed by another to the Ministry of Lands, Housing and Urban Development, asking the ministry to act on Tugume and Hasifa Namukasa who according to letter were plotting to grab the said land. According to letter, Nabitosi’s lawyers are concerned that their client is under continued threat from the Tugumes. The lawyers were also concerned by deliberate failure by the CID office at Kira Police Division for failing to investigate the murder of Ashraf Byaka on the said landViide Kira Division GEF 02/2020 while Tugume and Namukasa and their agents continue to disturb Nabitosi’s peace over own land.

LANDS MINISTRY RESPONDS

However, we have exclusively obtained that the ministry has responded, warning the RDC.

Lands Minister, Betty Kamya, in a letter dated November 12, 2020 told the RDC to ensure that no eviction or demolition is carried out.  

“The purpose of this letter therefore is to ensure that no eviction or demolition or harassment of occupants of the above land is carried out,” Kamya tasked the RDC, “The status quo should be maintained as decreed by Court.”

If Tugume and her accomplices are to follow the instructions of the minister, peace in the area will be restored.
