Family and children’s court of Mbale has issued warrant
of arrest for Umukuuka of Bamasaba Bob Mushikori
for illegally failing to pay sh4, 960,000 to his former allegedly wife who he
bore baby with and neglected.
Magistrate grade one in Mbale Docus Zako issued
warrant of arrest through Iddi Musingo T/A Gadunya high court bailiffs and Auctioneers
under FCC No. 136 of 2018. (O.22r. 35CPR).
“And whereas the total sum of sh4, 960, 000 has not
been paid to the applicant in satisfaction of the said order. These are to
command you to arrest the said Umukuuka (King) Mushikori unless the sum of sh4,
960, 000 is paid to applicant,” letter partly read.
The court order also further commanded to return the warrant of arrest on or before the 14th day of January 2020, with an endorsement certifying the day on which and the manner in which the order has been executed or the reason why it has not been executed.
“Any police officer is requested to arrest the said Umukuuka Mushikori in execution,” letter signed by magistrate grade one Docus Zako read.
The Chief Magistrate’s Court in
Mbale District last year started hearing a case in which the Bamasaba cultural
leader, Bob Mushikori, was in September 2018 sued for failing to take care of a
child he sired out of wedlock.
The Grade One Magistrate, John Paulo Wosawulo, started hearing the case late
last year.
This followed an application filed by Janet Nambuya through her lawyers, who
claims to be the child’s mother.
In her affidavit which this house
has seen, Nambuya claimed to be Mushikori’s former partner, adding that they
started cohabiting in 2013 before he was crowned king in 2015.
“I started the relationship with the respondent in 2013 and we got serious in
2014 when we settled together as wife and husband,” she states.
Nambuya said she was struggling to take care of the child. Nambuya also claimed Mushikiro locked her out of his house in 2016 when the relationship turned sour.
“Without any fault on my side and my child, he locked me out of the house and has failed to provide us with another place of residence,” she said.
In March 2016, Nambuya before quitting the “marriage,” claimed she was being psychologically tortured by the bodyguards who were blocking her from accessing the Umukuka’s home in Mbale Town.
The petitioner alleged that the
guards were undermining and abusing her as “an unrecognized queen, cohabiting
with the king.”
However, when contacted, Mushikori dismissed the allegations of refusing to
extend support to his daughter. “I have not at any time failed to provide
financial support to the said child. That lady hid my daughter in Namugongo,
Kampala, and she wanted to baptize her without my knowledge but I warned her
not to do so. She has failed to take care of the daughter,” he said.
“Let the court grant me custody of my daughter since I am better placed to meet
her welfare,” he added. Court adjourned the case.
The prime minister and as well as the minister in charge of protocol of the cultural institution Mathious Nabutere confirmed that the order of commanding Umukuuka to clear DFNA bills was received and the money was cleared in court. “You can go ahead to Issue warrant of arrest and yet Umukuuka cleared the DNA test bill but our challenge is that the woman has failed to avail the child for the DNA,” he said.
“Umukuuka is very clear that if the DNA results come out saying the child belongs to him he will take charge of the child,” he said.
