Customer moves to sue Uganda Breweries Limited over contaminated drink

Uganda Breweries Ltd the makers and distillers of Smirnoff Black are in trouble after one of their customer identified as Kalali Daniel consumed contaminated black Ice Smirnoff that led to serious running stomach and vomiting. He would later be admitted at Ndejje Health Centre! 1V .

Kalali Daniel, 33, a resident of Kanaba in Ndejje narrated that he went to his usual drinking spot at Discount Shop where he bought 2 bottles of black Ice Smirnoff and on reaching his home and took one, However, he says that in just seconds, he developed a running stomach, diarrhea and vomiting after which he was rushed to Ndejje Health centre 4 for treatment.

He revealed that at the health centre, medics  told him that he had consumed poisoned food.

“When I was discharged from the hospital, upon return at home I checked on the other remaining sealed bottle and shockingly got several particles inside the beer bottle which forced me to go back to the beer seller and complain,” Kalali said.

In a letter intention to sue by Kalali’s lawyers of  Mushagara   Associated Advocates and legal consultants (MAALC), learned counsel Sadam Isma pointed out that their client was admitted for two days from 8th to 10th December 2024  and that after thorough investigations by the medics, it was concluded that he was suffering from food poisoning. To date, their client remain under strict medical supervision and management.

“Our investigations reveal that the contamination of your product Smirnoff Ice Black was not due poor storage by your suppliers but rather production and packing negligence on your part as established in the precedent case of Donoghue v Stevenson,” reads part of the intention to sue that was received by Uganda Breweries Ltd on 17th December 2024.

Sadam Isma vowed to take court action Uganda Breweries if they do not come up to openly apologize to his client.

He warned consumers of Smirnoff to take extra care during this festive period or else they risk their lives more so those who consume during night hours where you can not notice the particles of the contaminated Smirnoff Ice Black.

Sadam Isma and his client are keeping the contaminated Smirnoff beer until they table it in court seeking for justice.
